PROBATE

Probate involves the process regarding one's estate upon death.  It has a four-fold purpose of identifying, gathering up, and protecting assets in which the Decedent had an interest; of providing due process rights to creditors and claimants to be notified and heard; of identifying and protecting interest of beneficiaries and heirs; and of providing the mechanism to distribute the estate to those entitled to receive it.  Various estate planning techniques often minimize or avoid probate, but each situation is unique.
